General Note:
It is important to read the terms and conditions before making the booking and company deem to understand that the passenger / traveller has agreed for all the terms and conditions
Passengers or individual travelers have to arrange for the transfers (to the hotel / to the airport) on their own for their pre – post bookings. Company can arrange for the same at additional cost.
Upon arrival at the airport, passengers are requested to follow the directions / instructions given, to meet our representative. Generally, the representative will arrive on time. There could be a delay while meeting company representative for various reasons which is beyond companies control and hence passengers are requested to wait for at least 30 min at the meeting point / information desk after your first communication with the representative.
Passengers are requested to call the numbers provided from the phone booth in-case of any difficulty while finding companies representative at the airport. Company’s representative will be at the designated place / information desk and wait for 30 to 45 minutes. Passengers who are unable to meet the representative for various reasons which is out of our control has to reach the hotel directly on their own.
Passengers must carry an international credit card for incidental charges at the hotel (your card will not be charged unless you use any additional services not mentioned in inclusions or for your personal nature).
Any requests, questions, complaints, feedback have to be made with the tour guide.
If you are on a group tour, there could be a delay in arrival or departure for surface transfers, due to many reasons which are beyond SHREE WORLD VACATIONS control. Passengers are requested to co-operate.
TERMS AND CONDITIONS
DEFINITION
A. “You”/”Client”/"Traveler" means the Person/Persons in whose name or on whose behalf the booking is made
B. “We”/”Us”/”Company” means SHREE WORLD VACATIONS
C. “Independent Contractors” means Hotelier/Hotel owner, Owner of any airlines or shipping company or Railway, Ferryboat owner/Operator, Coach owner/Operator, Independent Guide / Guide service company, or any other person or organization who has been selected by the company to render services to the client.
D. "Supplier" means company or individual who has tie-up or signed contract with "Independent Contractors" to serve the companies clients
D. “Tour Cost” means the amount proposed in the Total Tour Cost column in the Booking form.
BROCHURE / PROPOSAL
All information given in the brochure/proposal is based on the information available at the time of publication. We reserve the right to change or amend any brochure or published information on the website before or after your booking the tour due to any events beyond our control. In case we are aware of any changes sufficiently in advance, we will notify you at the time of booking, otherwise our Tour Manager or Local representative will inform you of the changes. Major road works may necessitate route changes in the itineraries, Indian restaurants may close or change management, all of these may cause us to make changes in the itineraries. Where we know of these sufficiently in advance we will notify you, otherwise our Tour Managers or Local Representative will inform you of the changes on the spot. There are also very big fairs and exhibitions, where all the hotels are fully booked well in advance, and therefore it may be necessary to stay in hotels in other cities. This brochure along with tour is published in December 2013 for the tours commencing from March 1, 2014. All previous brochures/proposals, Letters and any other modes of circulation stand cancelled with immediate effect.
MEALS AND SPECIAL REQUESTS
The menus are pre-set menus provided for meals on the tour. The types of meals are clearly indicated in the brochure/proposal. Unlike an airline, we cannot provide a special meal, nor do we guarantee a special diet to the client, except to the extent mentioned in the brochure/proposal and preferred by you. We however reserve the right to change the meal arrangement if circumstances make it necessary to do so. In the event that the client wakes up late and misses the breakfast / lunch / dinner offered to him/her or the client is out on his own and reaches late or in case of delay of flights or for any other reason whatsoever the client misses any meal including breakfast offered to him by the company, then no claim can be made for the meal/breakfast/hotels, which he has missed and not utilized. Special requests for room allocation, diet consideration on tour / cruise / flight etc. must be made in writing at the time of booking, but all such requests shall be subject to availability. The company can only put forth requests and cannot be assured. The Company will not be held liable for claims of damages or consequential loss if the company is unable to process such requests for want of availability. The company will not be responsible for any difference in the taste of food or behavior of hotel staff or service or any circumstantial, human error knowingly or unknowingly done by hotel / restaurant staff. Company doesn’t manage the food menu, hence, the food items and rates are solely decided by the hotel restaurant staff. We have no control on menu items or on food preparation or serving or servicing and we are not liable for any claims or refund whatsoever. We always strive hard to accommodate clients request but cannot guarantee.
HOTELS
You will be out sightseeing most of the time and hence we have taken care to select hotels which are convenient and comfortable. Hence sometimes they may be located away from the city center. Most of the rooms have private bath or shower. The hotels will either be those shown in the itinerary or of the same category. Due to trade fairs and conventions in the cities the hotels may be blocked out in advance. In view of this you may have to stay in hotels further away from the cities and itineraries may have to be altered / amended. Since the rooms are comparatively small, we would recommend only 3 persons in one room for your own comfort. Triple rooms are usually no larger than twin rooms and the third bed is often a rollaway bed / foldable bed or sofa put in a twin room for the night. Many hotels may not provide a rollaway cot as well and in this case the third passengers will have to adjust with the other 2 passengers. Many hotels may provide Queen or King size bed. Hotels have the rights to provide Double / Twin Beds Depending on the Occupancy on the day of Arrival as well as based on the Hotel ROH. All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from the hotel premises / coach / Airport / during travel or place of visit etc. Some hotels offer the facility of safe deposit lockers, which can be availed by you at your own cost and risk. The company will not be liable for any loss/theft from the same. Any damages caused to the hotel rooms / Coach / place of visit etc. during your stay/tour/visit, shall be borne and payable by you, and the company will not be liable for the same.
Early check-in and late check-out is under sole discretion of the hotels and it depends on the availability. Company is not liable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the hotels. The company will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotel or its staff. Rude or unprofessional behavior of hotel staff, tour manager, guides, drivers does not come under the direct purview of the company and the company will not be responsible for the same and the company will not be responsible for any untoward incident or unsatisfactory or lack of any services (be it inside or outside hotel). Facilities like mini bar, pay television channels, telephone, beverages etc., are not complimentary unless specified and these facilities if used by the client have to be paid for by the client directly to the Hotel and such charges are not included in the tour cost. The client will have to abide by the check in /check out time of the hotel. Any changes made directly by the hotel come under their direct purview and we will not be liable for any compensation due to this change. Hotels may ask for cash / credit card for incidental charges and guests will have to pay upfront at the time of check-in and will be returned back by hotels at the time of check-out after deducting money for usage for personal expenses like telephone, laundry, coffee /tea, water etc. Tax varies depending on the each hotel and room category and will be charged to client accordingly. Cancellation / refunds varies from each hotel / resort.
AIRLINE
The Company shall, in no circumstances whatsoever be liable to the client or any person traveling with him for Flight cancellation, Loss of Baggage by the Airline, Failure to provide meal of the clients choice by the Airline, Overbooking of seats by the Airline, Failure on the part of Airline to accommodate client despite having confirmed tickets, Meals offered by the airline/Quality of meal, Flight delay, if the client misses the flight, Changes of flight schedule/routing/airline mentioned at the time of booking. In this condition the expression ‘howsoever cause’ includes willful negligence on the part of any person. If in the event that the client is booked on a particular Airline on a particular date and due to certain reasons beyond the control of the Company, the client is not allowed to board the flight for any reason, the client shall not hold the Company responsible for the same and no claim whatsoever can be made by the client against the Company. Airport taxes / Airport Development Fee as applicable to be paid over & above the Tour Cost should there be a rise post the printing of the brochure/proposal. All the booking / cancellation / refunds / change of the airline ticket and the travel on such airline ticket will be subject to the terms and conditions of respective Airlines and the same may be provided to the client by the company upon request, if available. There will be no refund for all Low Cost Carrier airlines across the globe. Change in the name, date or any addition / deletion (if allowed by respective airlines) will be charged extra, these changes must be given in writing or e-mail and can only be done at advance notice or prior information. Last moment changes are not entertained. Cancellation / Date change / Rescheduling charges are airline specific and charges are levied on the traveler.
VISA
- SHREE WORLD VACATIONS is a travel agent company and ONLY facilitate the VISA process for its clients. We are in no way directly or indirectly related to any embassy nor represent them and cannot guarantee any VISA grant or reject.
- VISA grant or reject is at the sole discretion of the consulate or VISA officer of the respective embassy.
- The processing time can vary depending on person to person or case to case basis. We are not responsible in any way for the delay in VISA processing and clients should reschedule or change their travel tickets, itineraries, meetings accordingly (in case of delay) and bear the re-scheduling or any additional charges. No refund or compensation given in such cases.
- We cannot guarantee or commit on grant / submission / delivery dates.
- The processing fees may vary due to fluctuation in the respective countries currency.
- Clients must provide the appropriate documents before processing failing which processing cannot be done. Consular or VISA officer handling the respective case may ask for additional documents and clients must provide the same without which processing cannot be done.
- Passports, applications and documents cannot be taken back once submitted at the consulate till the VISA processing is completed.
- Clients MUST pay attention and double check to every information filled by you or by us before submitting the application. We cannot make any alterations in the application once it is submitted or no dispute will be entertained once application is submitted. It is clients sole responsibility to check every details and confirm with us before submission. .
- VISA fees and associated service fee are nonrefundable.
- Clients must fill the application on their own. No hand written applications are entertained and photographs should be according to the specification.
- Clients may have to attend for bio-metric and give a personal interview with the VISA officer and hence it should be pre-planned
ITINERARY CHANGES
We may often operate more than one coach per departure date. We may operate more than one group per departure or club 2 groups in one departure due to operational reasons. For the comfort and convenience of our passengers, we will sometimes reverse the direction, or slightly amend the itinerary including the flight routing. We will advise you of these amendments, prior to the start of the tour or on tour. We may modify the itinerary based on various factors like maintenance of historical monuments, museums, major events like sports conventions, religious festivals, etc. We may take a detour to reach sightseeing places due to traffic conditions; road blocks and that may vary the course of itinerary. We reserve the right to change the departure date or cancel a departure due to lack of enough number of passengers and will not take any responsibility for any ticket of the client which they may have purchased in advance for sector within India or abroad. Individuals are responsible for the adherence of time at all stages of the tour. In the event that a client misses on any part of the sightseeing tour or any such tour due to delay on his part, he will not be entitled to claim refund of the same. The company shall not accept any liability or responsibility for any damages, loss, baggage loss, injury, accident, death, breakdown, or irregularity, which may occur in carrying out the tour arrangement, weather conditions, strikes, war, quarantine and any other cause whatsoever and all such loss or expense must be borne by the passengers. The management reserves the right to claim any additional expenses incurred due to delay or changes in schedules of train, airplane, bus, ship or other services. We reserve the right to amend, alter, vary or withdraw any particular departure; excursions advertised or substitute a hotel of similar category if deemed necessary. For the convenience of our clients we will sometimes amend / alter the itinerary, however all services will remain the same.
LOSS/DAMAGE
Company is not responsible for any loss or damage to personal belongings during the stay in the hotel or while traveling in the coach. Due to theft or loss of baggage, tour participant can lodge a complaint with the local authorities on his/her sole discretion, cost, risk and consequences.
COACH/SITTING
We use air-conditioned and non A/c /air-cool Luxury or Deluxe coaches/ SUV/ Vans/ Cars. However, sometimes due to extreme weather conditions the same may not seem to be very effective. The company will not be responsible for any defect in the Coach or in the Air-conditioner / air cooler or for the behavior of the driver or the attendant.
We have found it fair to operate daily seat rotation on board our coach, so no seat numbers are allocated. The coaches are equipped with an emergency washroom; however this facility is not to be used in lieu of the rest rooms at our frequent comfort stops. If you are carrying any high value items on the coach, we advise you not to leave them behind when you leave the coach. We will not be responsible or liable in case of loss of such items from the coach. All baggage and personal effects are at all times and in all circumstances your responsibility. Any damages caused to the coach during your travel, shall be payable by you and the company will not be liable for the same. The drivers are bound by specific rules, like maximum driving hours within a day and during a week, rest period per day / week etc. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel, otherwise certain sightseeing schedules may be missed due to your actions/ delays and the same will be non-refundable.
ACCOMMODATION FOR CHILD BELOW 12 YEARS OF AGE
It is expressed and given to understand that a child below 12 years of age who is booked on the tour paying the special rate without a bed will not be provided with a bed in the hotel while on the tour under any circumstances. In case the client makes any changes in their rooming while on the tour, the company shall not make any refunds or pay any compensation to them. In case the client decides to make any change in the rooming while on the tour subject to availability, then they shall be bound to pay additional charge.
REGISTRATION
In cases where the travel agent through whom the clients have booked the tour signs the Booking Form for and on behalf of the persons named in the Booking Form, it shall be deemed and construed that the clients have duly authorized the said travel agent to sign on their behalf. The signing of the Booking Form by the Client or by their travel agent shall mean acceptance in totality of the Terms and Conditions contained herein by the Client/s. No person including the Employee/s and the Agent/s of the Travel Agent other than the Company, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition set forth in this Brochure / proposal. Any assurance given by any person shall have no consequence. The Company reserves the right to decline to register any person/s as Client/s for any Tour or to cancel their registration without assigning any reason.
TRANSFER FROM ONE TOUR TO ANOTHER
A transfer from one tour to another, prior to the departure of the originally booked tour will be treated as a cancellation on that tour, thereby attracting the cancellation charges as stated hereunder and a fresh booking on another tour.
PAYMENTS
All payments towards the tour cost must be made by the client to the company in accordance with the procedure and time frame mentioned herein below. All payments towards made prior to the tour departure date will have to be paid in cash/Demand Draft/Bank transfer. The PAN Card copy will be required when payments amounting Rs.25,000/- or above are made by cash. Payments made towards the foreign exchange component of your tour will be calculated as per the ROE (rate of exchange) of that given day.
Payment terms:
- Advance booking Per Person non-refundable charges: 10,000 INR per person + GST or as per payment procedure for all international package has to be paid
- Full payment as per the invoice must be made in accordance with the procedure stated above. In case of non-compliance thereto by the client, the company reserves a right to cancel the tour/booking of the client with subsequent loss of deposit and apply and recover the cancellation charges as mentioned herein.
- All payment instruments or channel charges are extra and has to be borne by the clients
- All additional payments (if any) has to be paid in accordance with the invoice
- Bank charges for international packages are extra payable by client
- EMI on credit card is applicable only to credit card issued by Indian banks. Acceptance / Rejection is sole discretion of banks or issuing authority
- International transfers are done through Paypal or direct bank transfers.
- Only selected bank credit cards are accepted.
- Credit / Debit card and Net banking charges and associated service taxes are extra and payable by client
- Full amount to be paid 45 days prior to the departure date of the tour
- All payments are done in Indian Rupee and the final invoice may vary depending on ROE [Rate of exchange] on the date of making payment.
- Service fee of Rs.300/- (Domestic) and Rs.650/- (International) per person towards air ticket booking and Rs. 250/- (Domestic) and Rs,350/- (International) for rescheduling in addition to airline charges. This service fee + GST is non refundable incase of cancellation or any changes.
- Service fee and associated GST charges are not refundable if traveler cancels the ticket at the time of refunding.
REFUNDS
- Refunds (If any) for amendments and / or cancellations will be paid directly to the travel agents for bookings made directly with the company’s office or travel agent. For bookings routed through our Preferred Sales Agent (PSA) or Travel Agent, the refunds will be routed through them. It would take at least 30 to 45 working days to process refunds. There is no refunds payable for any unutilized or partially utilized services (e.g. Airline tickets, Meals, Entrance Fees, Optional Tour, Hotel, Sightseeing or even the package tour etc.) The refund will be in INR only. Service tax, payment gateway charges, Company service charges + GST, any commission paid to the company and bank charges are deducted and will be refunded. Third Party refund i.e. airlines, hotel, cruise and all other overseas suppliers could take between “30 to 90 working days”, provided relevant supporting documents are provided to the Company and supplier. If a tour is cancelled by the Company, then all monies will be refunded after taking into consideration the actual expenses incurred for hotel blocking / company service fee etc. Similarly, if a booking is canceled by the traveler, for any reason, cancellation penalty / fees are deduced as per company cancellation policies and rest would be refunded. Passengers may be asked to provide or submit all the correspondence / written communication, bills / vouchers at the time of refund, without which the refund process cannot be initiated.
- There will be no refunds for any natural disasters or any incident which may be considered as Act of God or man made disasters. However, during any natural disaster or any untoward incidences which may be considered as Act of God or man made disasters, the supplier / company may offer new travel dates to the travelers. There could be changes in the package price due to various circumstances. The difference in the price has to be borne by the traveler. If the traveler disagrees to travel on the proposed new travel dates, then, it will be considered as cancellation from traveler's side and cancellation fees and penalties will be applied.
- All refunds (if any) will be made to the client in accordance with the selling ROE (Rate of Exchange) which we receive from the supplier. Any refunds above 25000/- are made ONLY by NEFT or Cheque. Refunds made towards the foreign exchange component of your tour will be calculated as per the ROE (rate of exchange) of that given day (pro rata basis) or ROE received from the supplier.
- Traveler also agree that every company / supplier / hotels / airlines has their own cancellation and refund policies and they hereby adhere to it.
- Most of the package prices are Non-refundable or partially refundable and comes under 100% cancellation after making payment. I understand SHREE WORLD VACATIONS is not responsible for any refunds or cancellations due to any natural and manmade disasters as mentioned above in clause 3 & 6 in BOOKING FORM . During this unprecedented time if there are any natural and manmade disasters, before the travel or while traveling any Refunds and cancellation depends on supplier’s policy. Supplier at his / her discretion may offer you options such as a) Credit shell b) Vouchers c) Refund after deductions (service charges) d) Change or offer a different travel date e) Full cancellation or f) Find a replacement to travel on their behalf
DEVIATIONS
If a passenger wish to travel in advance i.e., before the published departure date as mentioned in the brochure/proposal or like to come back on a later date after the tour ends, there will be an additional charge that will be applicable (subject to availability of seats for the given dates & ticket validity) which will be advised to you by the staff / travel agent. Kindly note, the deviation will be actioned only 30 days prior to departure date. The request for deviations should be given in writing to the company at the time of booking as these requests are subject to availability and we are not holding seats for the same. The deviation request will be subject to availability and payment for the same does not guarantee the date requested. In case the dates requested by you are not available; the company will allot alternate dates accordingly, subject to seat availability in the group booking class. However in case the client wants to travel on a particular date only, and the same is not available in the group booking class, the difference in amount has to be borne by the client.
SCOPE OF ACTIVITY
We are travel and holiday organizers only. The role of the company is that of an agent or facilitator for the traveler to secure proper services for the tour from the independent contractors and service providers such as the airlines, shipping company, hotels, Coach, guides etc. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, hotel, transport or any other facility or all other services mentioned in this brochure / proposal / website. We take care in selecting all the ingredients in your holiday; but because we only select them and have no control in operating them, we cannot be responsible for any injury, death, loss or damage, which is caused by the act of god, natural disasters or default or omission of the management or employees of any hoteliers, airlines, shipping company, coach owner / coach operator / guides / escorts / manager who are the company’s independent contractors arising outside our normal selection process.
PRIVACY OF INFORMATION
We treat all the information furnished by you as confidential and will share only the necessary information with airline, hotels and other service providers who will provide the services to you during your tour. However we may be constrained to disclose the information furnished by you, if such disclosure is required by the law or by an order of a court or the rules, regulations or inquiry by any government / statutory agency having regulatory authority over the Company.
CONDITIONS OF PASSAGE
These conditions are applicable to every Client of the Company, who books a Tour or any Special Tour or travel arrangement. In the event of a Client booking through us a Tour and/or Tour Arrangement of any other Tour Operators or suppliers like Royal Caribbean, Carnival, Cosmos, Star Cruise or any other operator etc., the “Terms and Conditions” specified by such Tour Operator, including their payment schedule, cancellation, refund etc. shall be applicable, in addition to our “Terms and Conditions” while determining the contractual relation between the Client, the Tour Operator and us.
HEALTH DECLARATION
HEALTH AND INSURANCE shall be the duty of the Client to inform the Company in case the Client has any medical condition that may affect his ability to enjoy and pursue fully the Tour Arrangements and wherein the interest of the Group or any member thereof is prejudicially affected. Pace of certain tours might not be suitable to individuals. Hence we suggest that individuals may choose tours as per their health conditions. The Company reserves the right to ask the Client to provide written certification of his medical fitness before departure. In the event that a medical condition has not been disclosed the Company will not be liable to provide any assistance or money back. It is necessary for the client to obtain valid travel/health insurance prior to the commencement of the tour and the company will not be responsible for the same. Settlement of the claims will be entirely at the discretion of the insurance company. The tour participant should check the accuracy and correctness of the insurance policy. Company will not be responsible for any issues related to medical while at the journey or tour.
INSURANCE
Travelers must ensure to have health and travel insurance with Coverage against financial losses arising due to expenses as a result of hospitalization while travelling, loss of luggage, flight delays or cancellations or NO SHOWS due to natural and man made disasters, Hospitalization expenses cover on account of sickness (general and or due to Covid 19 or any epidemic / accident. Trip interruption, trip cancellation and trip extension due to sickness, injury or death in the family and or any untoward incidences that result tour halt.
Any additional expenses spent due to natural and man made disasters such as land slide, heavy snow fall, blockage, floods, riots, terrorist attack or any untoward incidents which may result in paying additional expenses or financial loss.
Cover against loss or theft of your baggage and passport. Emergency evacuation expenses, due to a natural calamity or man made disasters or any attacks, riots or terrorist activities, including the return flights home.
COMMUNICATION
Any communication directed at the address or made through/on the contact details such as e-mail id, cell phone/ telephone no./fax no. of the Client as disclosed in the “Booking Form” or made to the travel agent through whom the client has made the bookings with the company shall be deemed to have been communicated to and received by the Client. The Company shall not responsible for any error on part of mode of communication or the Travel Agent in this regard.
CONDITIONS OF TRAVEL
The Client will have to strictly follow the Tour Program and return to India as per the tour itinerary.
There shall be no refund, if the client fails to join the group at the commencement of the tour, or joins the group later or leaves the group before culmination of the tour. It shall be noted that for all purposes, it shall be the responsibility of the Client to reach the place of commencement of the Tour and register with the representative of the company at the appointed place, date and time. In case if a client along with his family is compelled to discontinue the tour due to any reason whatsoever including illness, death or loss of passport or any travel documents, no claim shall be entertained for refund of unutilized services.
Even if a client is unable to reach the place of commencement of the tour due to any reason whatsoever including loss of baggage or loss of travel documents, his booking shall be treated as “no show” on the tour and 100% cancellation charges will be levied.If a client avails pre - tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets or pre- tour arrangements or part thereof, it shall be treated as “no show” and there will be no refund whatsoever for the unutilized pre-tour or main tour services.
The Company, reserves the right to withdraw tour membership from anyone whose behavior is deemed likely to affect the smooth operation of the tour or adversely affect the enjoyment or safety of other passengers and the Company shall be under no liability to any such person. It is hereby declared that the immunities provided under this contract shall be available to the Company’s Managers, including Tour Managers, Employees, Servants and Agents but not to the Independent Contractors selected by the Company. Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect.
No liability on the part of the Company arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the tour holiday, and shall in no case include any consequential loss or additional expense whatsoever. The prices quoted in this brochure/proposal have been calculated at the rate prevailing at the time of printing of this brochure/proposal.
The Company reserves the right to amend the prices published in this brochure/proposal in case of currency fluctuations, changes in the various gross rates of exchange, and/or fuel costs, special/high season charge levied by the suppliers, hike in the airline/rail charges before the date of departure and to surcharge accordingly. All such increases in price must be paid for in full before the Departure by the Client. If you book with your own travel agent and your booking with that agent includes, but is not limited to company arrangements, your contract is with your travel agent and SHREE WORLD VACATIONS is simply an agent to your travel agent. In case of publication of any travel scheme offering any discount or benefit by the Company, it shall have the sole right to withdraw such a scheme or discount at any time unless a specific assurance of the contrary is published. The company shall in no circumstances whatsoever be liable to the client for: Any over stay expenses due to delay or changes in bus/ air/ trains / ship/ or cancellation of special bogie or other services due to sickness, weather conditions, strike, war or any other cause whatsoever. Sightseeing missed & / or program being cancelled after the commencement of the tour & before the due period due to any unavoidable situations which are beyond our control. Any Loss/Damage of baggage by the Airlines/Hotels/Coach.
- In the case of one or more but not all passengers signing ‘Booking Form’ it shall be deemed that others have duly authorized concerned signing passenger/(s)
- Initial deposit just ensures only registration/participation on the tour but does not entitle any services like Tickets, Visas, and Hotel Accommodation until full payment has been received.
- We cannot endow with individual aid to any of the tour member for walking, dinning, getting on & off from any of the transport vehicle or other personal needs. So it is indispensable that a qualified companion must accompany such traveler who needs such assistance. In the absence thereof, such traveler will be joining the tour on his own risk and consequences.
- The client/Traveler must have his/her passport valid for at least 6 months subsequent to such departure.
- Company solely reserves the right to publish group photographs of the passengers taken during the tour.
- Distance, temperature & pre/post tour accommodation prices given in the Brochure/proposal are approximate & are subject to change.
- Photo of meals & sightseeing published in the Brochure / itinerary proposed are only for reference & may change from actual meals served/ sights.
- In case company offers any adventures activities then it is significant to note that all the passengers should enjoy such activity/ ride at their own risk as such kind of adventure might be risky at times especially for heart patients, expecting women, people with Blood Pressure etc.
- The group tour will be operated subject to a minimum of 30 full paying passengers traveling together. The services of company Tour Manager will be provided with a group of minimum 30 full paying passengers. Our local representative will be there to assist you in case the above requirement is not fulfilled. When the tour has less than 15 adults and is operated on seat-in-coach basis, there will be instances where the drivers act as a guide as well.
OTHER TERMS
- There is no Contract between the Company and the Client until the company has received the full amount-.
- The company has the right at any time and for any reason:
a) To terminate this contract after acceptance of deposit but prior to the Commencement of Tour without assigning any reason whatsoever. In the event, the company terminates this contract, the company shall refund (if any) the amount paid by the client without payment of any interest and after the necessary deductions like service charges, ROE charges etc.
b) To amend, alter, vary or withdraw any tour, holiday, excursion airline, flight routing or facility or discounts / concessions it has advertised or published or to substitute an Independent Contractor of similar class if it is deemed advisable or necessary. In either case, the company shall not be liable for any damage, additional expense, or consequential loss suffered by the clients or for any compensation claims made.
- No person other than the company, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition in the brochure.
- In the event of the company exercising its rights to amend or alter any of the services as mentioned in the itinerary, after such tour or holiday has been booked, the client shall have the right:
a) To continue with the tour or holiday as amended or altered or,
b) The company shall not be liable to the client for any damage, additional expense, consequential loss suffered or to pay any amount as refund.
c) To cancel the tour, in which event the cancellation charges as stated herein shall apply and the client will be liable to pay to the company such charges.
- The company shall in no circumstances whatsoever be liable to the client for :
a) Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and / or damage or any misadventure howsoever caused.
b) Any act, omission, default of Independent Contractor or other person or be any servant or agent, employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facilities or service for the client or for any person travelling with him howsoever caused.
c) The temporary or permanent loss of or damage to baggage or personal effects howsoever caused. In this condition the expression “Howsoever caused” includes negligence on the part of any person.
- If the client has any complaint in respect of the services provided by any of the Independent Contractors, the client shall immediately notify the same in writing to the company and a copy thereof should be handed over to the Tour Manager / Guide of the company in order to enable the company to take up the matter with the Independent Contractor so that in future other clients do not face the same difficulty.
- Any claim or complaint by the client must be notified to the company in writing within 7 days of the end of this holiday tour. No claim notified to this company beyond this period will be entertained and the company shall incur no liability whatsoever in respect thereof.
- The tour is subject to RBI / GOI rules & regulations. Part of the tour cost will be paid in USD/INR out of your BTQ.
FORCE MAJEURE
-The Company shall be excused from the performance or punctual performance of any of terms and conditions/services/tour or part thereof as above, if the performance thereof is prevented or delayed by any cause beyond the reasonable control of the company and it's suppliers or partners, which shall include acts of God, riots, wars, accidents, embargo, terror attacks, epidemic, pandemic, coup strike, natural calamities or requisition (acts of government), or delays/negligence/carelessness in the performance of the independent or third party contractors caused by any such circumstances as referred herein. Any additional or supplement cost for the services (accommodation, travel, food, travel related bookings, rescheduling etc.,) during the Force Majeure event, shall be paid by the Client directly in addition to the full payment already made towards tour booking.
a) All dispute/complaints with respect to these terms and conditions and the tour and services shall be subject to the jurisdiction of Courts at Bangalore only.
b) Upon signing the booking form, these terms and conditions shall be binding on both the company the client and shall become the only basis of relations between the parties and all previous communications in whatsoever form or mode, whether oral or otherwise, with respect to any term or conditions of the tour and services shall stand cancelled /revoked/terminated.
c) Once the payment is made, it is deemed to understand that traveler or their representative has read the terms and conditions mentioned herein this page and understood
d) I understand SHREE WORLD VACATIONS is not responsible for any refunds or cancellations due to any natural and manmade disasters as mentioned above in clause 3 & 6 in BOOKING FORM. During this unprecedented time if there are any natural and manmade disasters, before the travel or while traveling any Refunds and cancellation depends on supplier’s policy. Supplier at his / her discretion may offer you options such as a) Credit shell b) Vouchers c) Refund after deductions (service charges) d) Change or offer a different travel date e) Full cancellation or f) Find a replacement to travel on their behalf
CANCELLATIONS , PENALTIES, REFUNDS
- Cancellations policy and penalties depends on country / package and Supplier specific and each package has separate cancellation policy and penalties.
- Full Payment is due 45 days or earlier prior to the departure of the tour, failing which the reservation can be cancelled and the Booking Amount (If any) will be withheld.
- A separate fee will be charged for change in the name, change in the travel date per person / per transaction or any other revision made to a confirmed reservation.
- The company reserves the right to cancel any tour prior to the departure, without assigning any reason. In such an event, all monies paid by you will be refunded forthwith in Indian Rupees currency only, but no compensation or interest will be payable. Company will hold any charges / service fees at the time of refund.
- In case of cruises, 100% of the cruise cost paid will be forfeited in case of any cancellations, irrespective of time of cancellation. The company cannot assume responsibility for any additional cost or any fees relating to the issuance and / or cancellation of air tickets or other arrangements not done through the company.
- The company reserves the right to forfeit the advance amount or booking deposit (if any) & any other actual expenses over and above booking deposit in case of any cancellations (including Visa rejection or delay in processing) and refund the balance amount. All the clients travelling on the company tour must be in possession of a valid visa. It is mandatory to submit a copy of air tickets, passport copy and all the relevant visa documents at least 15 days prior to departure. However kindly note that it is entirely at the discretion of the concerned Consulate / Authorities to grant / reject visa even after submitting all relevant documents and the company will not be held responsible for the same. The company is not at all liable for such cases or has any influence on the consulate/embassy’s decision. The role of the company is only to provide necessary guidance to the client for the purpose of applying for VISA. The company will not be responsible for non-issuance of visa due to receipt of incomplete / delayed documents from the Clients. It is a possibility that the consulate may ask the passengers to appear for a personal interview. This is at the sole discretion of the Consulate / Authorities. If the required documents are not submitted by the client, the issuance of visa will further be delayed / rejected, and the client will not hold company liable for the same. Client should adhere to all the norms and conditions laid by the consulate/embassy. Upon rejection of visa, if the client wishes to reapply for the visa, he/she is liable to pay again the requisite fee to the consulate and he/she will not claim from company.
- For any reason if traveler cancels the tour programme or booking after making any partial or full payment, a 10% + GST penalty charges on the total invoice value will be forfeited / levied towards SHREE WORLD VACATIONS service charges in addition to the hotel, land package cancellation charges (if any).
- The cancellation and refund policies depends on each hotels, sightseeing tours, airlines, entrance tickets, transport companies etc., The refund depends on the cancellation time and supplier terms and conditions.
- There are No refunds for Non-refundable bookings and No refunds after cancellation period.
- No refunds in case of natural disaster or any incident which may be called as Act of God or even man made disaster. In such case supplier / company may offer a new travel dates with certain terms and conditions. If traveler rejects the offer, it is deemed to understand that he / she has cancelled the travel plan and no refund request will be entertained.
- Cancellation penalty / fees is levied on the traveler for all cancellation made by him /her as per the supplier and company policy.
- Most of the package prices are Non-refundable or partially refundable and comes under 100% cancellation after making payment. I understand SHREE WORLD VACATIONS is not responsible for any refunds or cancellations due to any natural and manmade disasters as mentioned above in clause 3 & 6 in BOOKING FORM. TOUR MANAGER / GUIDES
Company provide tour guides to its travelers who are seeking to obtain guide / tour manager services.
You understand that the tour guides / managers are independent contractors and that the tour guides are not employees or agents of the company.
You hereby understand and expressly agree that company does not control the quality, timing, legality or any other aspect whatsoever of the services actually delivered by the tour guides, nor of the integrity, responsibility or any of the actions whatsoever of the tour guides.
Company uses its best efforts to monitor tour guide, service offerings, actions and comments, By using our services, you agree to report any alleged improprieties of any tour guides to company immediately.
ACCEPTANCE OF RISK AND WAIVER OF LIABILITY
Travelers acknowledge that all travel involves an element of risk and that some tours offered may be adventurous in nature and may involve a significant amount of personal risk. You hereby assume all such risk and your family, heirs and assigns hereby release SHREE WORLD VACATIONS and its employees and partners / contractors from all claims and causes of action whatsoever arising from any injury, death or other damages, both pecuniary and non-pecuniary, to you that may occur as a result of your participation in the tours offered or as a result of the negligence of any party, including the tour guide or any employee, officer, agent, contractor or assign of company, whether such negligence is passive or active.
Prior to tour commencement, travelers or their representatives MUST fill the booking form and sign a Liability Release clause stated in the BOOKING FORM.
It is deemed to understand that every traveler has read and understood the Terms and Conditions mentioned in https://www.shreeworld.com/terms-and-conditions of SHREE WORLD VACATIONS and made the payment.
You are strongly encouraged to obtain suitable medical insurance prior to booking a tour.
We urge you to exercise caution if you purchase any goods during your tour. Neither the company or the tour guide make any claims about the quality, source or other provenance of any goods which may be available for purchase.
Company is not responsible if airlines deny to check-in the goods purchased while on the tour.
Company is not responsible for any customs inquiry regarding traveler goods or purchased materials.
MODIFICATION OF THE TERMS OF THIS AGREEMENT
Company reserves the right to make changes to this Agreement from time to time and in no way responsible if it is not read and understood before making any booking.
INDEMNITY
You agree to defend, indemnify and hold harmless companies tour guides, drivers, its parent or related corporations, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from all the terms and conditions mentioned above.
LIMITATION OF LIABILITY
Under no circumstances will SHREE WORLD VACATIONS be liable to travel agents / individual travelers / groups for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this Agreement or from the provision of any tours or other services purchased from the company. Furthermore, the TOTAL liability of SHREE WORLD VACATIONS arising with respect to this agreement shall in no event exceed the total amounts paid by travel agent / individual travelers under this Agreement.
NOTICE
Any notice or other communication to be given hereunder will be in writing and given by facsimile, post-paid registered or certified mail return receipt requested, or electronic mail.
LEGAL CLAIM
For all disputes between company and travel agents or individual travelers regarding services, this Agreement, transactions facilitated or conducted through the electronic mail, tours and travel services ordered or purchased through the Site, dealings between travel agents and individual travelers , or any related matters ("Disputes"), the parties will attempt to find the least amicable solution to the Dispute instead of onerous in approaching the Court of Law for the settlement. If a Dispute cannot be resolved by the parties, then the Dispute must be resolved before the courts of the Bangalore, Karnataka, India and you hereby irrevocably submit and attorney to the exclusive jurisdiction of the courts of the Bangalore, Karnataka, India in respect of all disputes. Proceedings regarding disputes must be commenced in a court of competent jurisdiction in the City of Bangalore, Karnataka, India, within ONE (1) month from the travel date. Any shorter time limit provided by statute or other law remains unaffected.
Each party is not liable to pay the cost incurred by them towards the court fees or attorney fees and any other misc charges in the court proceedings or at the time of settlement. Each party has to bear their expenditure on their own towards the same.
Important Note:
- Company will block the rooms and does not guarantee any accommodation or tickets till the fully payment is received.
- Accommodation and tickets (Air, Train, and Bus) are subjected to availability at the time of receiving your reconfirmation and you have to receive our reconfirmation back with the revised quote, if any.
- Air Fares proposed are tentative or tentatively booked only and are subject to changes and not guaranteed until the air tickets are issued Or Re-issue.
- 100% of the total Billing amount to paid at the time of confirmation of the package or before departure as per the SHREE WORLD VACATIONS policy.
- Cancellation charges will be according to hotel/resort/airline policy Rates re subject to change in forex.
- Any additional Services will be charged extra.
- Ticket price generally includes taxes and surcharges but there may be exceptions where tax should be paid locally at the time of check-in.
- Any deviation in the tour, change in the travel dates, any addition / deletions / extensions, any change in type of accommodation, date changes etc, Ticket refunds, re-issues, and all other changes (where permitted by the airline/ cruise, hotels) may incur respective independent contractor penalties and SHREE WORLD VACATIONS fees. Ticket validity, availability also depends on the conditions of the fare. In addition to the stipulated airline cancellation fee, all airlines will also charge a Refund Admin Fee (RAF).
- Seating and Food are on request basis only and are subject to confirmation from respective airline. Passenger should be responsible to ensure that he has the relevant visa or transit visa with a passport having a validity of minimum 6 months and that he may comply with all immigration requirements.
- Flight times may change at the sole discretion of the airline. It is recommended to reconfirm the flights departure times and terminal with respective airline at least 24 hours before departure.
- All tickets are subject to date change and cancellation penalties with exception of some tickets being non-refundable but reusable later as per the rules of airline. Partially or half-utilized tickets are non-refundable.
- All tickets have a ticket validity within which the travel has to be finished, and date change on the ticket can be done only as per validity of ticket. Further details on it can be availed from SHREE WORLD VACATIONS.
- Infant is defined as a traveler whose age must be under 24 months throughout the entire journey, If the infant is 24 months or above on the return journey then the infant fare would not apply but a new ticket applicable under child fare should be brought.
- Maximum of one infant is allowed to travel with each adult passenger. In case of more than one infant is travelling with one adult, first infant would be charged the infant fare but for the second infant applicable child fare would be charged.
- Passengers are requested to carry international credit cards. The hotel authorities may use the credit card for incidental charges and the same amount will be reversed back at the time of check-out. This is solely individual hotels policy and its discretion. Our company has no hold and cannot avoid this.
- On behalf of the persons named in the booking form, I have read and understood the terms and conditions as mentioned here in above and as mentioned in the Brochure / Proposal.
- Cancellation and refund policies depends on each hotels, sightseeing tours, entrance tickets, transfers etc., The refund depends on the cancellation time and operator terms and conditions. Below is only the indicative cancellation charges and it may vary.
- No refunds for Non-refundable bookings and No refunds after cancellation period.

We take utmost care in selecting each and every ingredient in your holiday; in most of the cases we inspect them but have no control in running them, we cannot be responsible for any delay, improper services provided by any of our supplier, airline, car rental company, cruise liner, coach company, hotel, apartment, transport or any other facility or service, for any injury, death, loss or damage which is caused by the act or default of the management or employees including their negligence, unruly behaviour of airlines, car rental company, hoteliers, coach company, apartment or and any other supplier who are company's partners / suppliers.
